Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Face Aging AI ("we," "us," or "our") concerning your access to and use of the Face Aging AI website and service (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last Updated" date and, where appropriate, by providing additional notice such as a banner on the website. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Face Aging AI is an artificial intelligence-powered service that allows users to upload photographs of faces and receive transformed images showing how those faces might appear at different ages. Our service uses advanced machine learning algorithms to analyze facial features and apply realistic age-related transformations.

The Service is provided on an "as-is" and "as-available" basis. We strive to maintain high uptime and reliability, but we do not guarantee that the Service will be uninterrupted, secure, or error-free. Technical issues, maintenance, updates, or factors beyond our control may occasionally cause interruptions or degraded performance.

Our Service currently supports:

• Still image processing (JPEG, PNG, WebP formats)
• Age transformation for adult faces
• Single-face processing per upload
• Downloadable results for personal use

Age Requirements

You must be at least 13 years old to use Face Aging AI. By using the Service, you represent and warrant that you are 13 years of age or older. We do not knowingly collect information from or direct any of our content specifically to children under 13 years of age.

If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you represent that you have reviewed these Terms with your parent or legal guardian and that they agree to these Terms on your behalf. Parents and guardians are responsible for monitoring and supervising their children's use of the Service.

Account Registration

Currently, Face Aging AI does not require account registration for basic use. If we introduce user accounts in the future, you will be responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You are responsible for providing accurate, current, and complete information during any registration process. You agree to update your information as necessary to keep it accurate and current.

When using Face Aging AI, you agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• To harm minors: To upload, process, or distribute images of minors without proper parental or guardian consent.

• For malicious purposes: To create deepfakes, fraudulent identity documents, or content intended to deceive, defraud, or cause harm to others.
• For commercial exploitation: To use processed images for commercial purposes, advertising, or resale without our express written permission.
• To circumvent security: To attempt to bypass, disable, or interfere with security-related features of the Service or features that prevent or restrict use or copying of any content.
• To overload systems: To introduce viruses, trojans, worms, logic bombs, or other malicious or technologically harmful material, or to place excessive burden on our infrastructure through automated means.
• To violate intellectual property: To upload content that infringes on patents, trademarks, trade secrets, copyrights, or other proprietary rights of any party.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this Acceptable Use Policy, including removing content, terminating access to the Service, and reporting violations to law enforcement authorities.

Our Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Face Aging AI and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of the United States and foreign countries.

Our trademarks, service marks, and logos used and displayed on the Service (collectively, the "Trademarks") are registered and unregistered trademarks or service marks of Face Aging AI. You may not use the Trademarks without our prior written consent. All other trademarks, service marks, and logos used on the Service are the trademarks, service marks, or logos of their respective owners.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. This license does not include any right to:

• Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content, software, products, or services obtained from the Service
• Reverse engineer, decompile, or disassemble any part of the Service

Your Content Ownership

You retain all ownership rights to the photographs you upload to our Service. By uploading a photo, you grant us a limited, non-exclusive, royalty-free, worldwide license to use, process, and display your photo solely for the purpose of providing the age transformation service to you.

This license terminates automatically when your photo is deleted from our servers, which occurs immediately after processing is complete. We do not claim any ownership over your original photos or the transformed images we generate for you.

The AI-generated transformed images are provided to you for your personal use. You may download, save, and share these images for non-commercial purposes. However, you acknowledge that the transformation technology and the specific processing applied to create the aged image remain our intellectual property.

By using Face Aging AI, you represent and warrant that:

• All information you provide is accurate, current, and complete
• You have the legal right to upload and process all photos you submit to the Service
• For photos containing images of other people, you have obtained all necessary permissions and consents from those individuals
• Your use of the Service does not violate any applicable law, regulation, or third-party rights
• You will not use the Service for any illegal, harmful, or fraudulent purpose
• You will comply with all applicable laws regarding the transmission of technical data exported from your country of residence
• You have not been previously suspended or removed from the Service

You acknowledge that Face Aging AI is not responsible for verifying that you have obtained proper permissions or consents for uploaded images. You bear full responsibility for ensuring that your use of the Service complies with all applicable laws and respects the rights of others.

Service Disclaimers

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, FACE AGING AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will function uninterrupted, securely, or be available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements or expectations
• The age transformations will be medically, scientifically, or predictively accurate

Accuracy of Results

The age transformations generated by our AI are for entertainment and educational purposes only. They are not scientific predictions of how you will actually age. Many factors influence aging—genetics, lifestyle, environment, health—that our AI cannot account for. The results should be viewed as artistic interpretations, not medical or scientific forecasts.

Face Aging AI makes no representations or warranties regarding the accuracy, reliability, or completeness of the age transformations. You acknowledge that results may vary in quality and accuracy, and you use the Service at your own discretion and risk.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FACE AGING AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the greatest extent permitted by law. In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have paid to us in the last twelve (12) months, or one hundred dollars ($100), whichever is greater.

You agree to defend, indemnify, and hold harmless Face Aging AI, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of the Service
• Your violation of any rights of another person or entity, including privacy rights or intellectual property rights
• Photos you upload without proper authorization or consent
• Any false or misleading information you provide
• Your violation of any applicable laws or regulations

This indemnification obligation will survive the termination of these Terms and your use of the Service. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with us in asserting any available defenses.

Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part or feature thereof) at any time with or without notice. We may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability.

We may update, change, or discontinue any aspect of the Service for various reasons, including but not limited to: improving user experience, addressing security concerns, complying with legal requirements, or business decisions. You agree that we will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Termination of Access

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of applicable laws or regulations
• Fraudulent, harassing, or abusive behavior
• At our sole discretion for any other reason

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may also discontinue your use of the Service at any time. If you wish to terminate your relationship with Face Aging AI, simply stop using the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Your use of the Service may also be subject to other local, state, national, or international laws.

Dispute Resolution

If you have a dispute with Face Aging AI, we encourage you to first contact us at dev.ezzooooo@gmail.com to attempt to resolve the issue informally. We are committed to working with you in good faith to reach a fair resolution.

If we are unable to resolve a dispute through informal means, you agree that any legal action or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal or state courts located in San Francisco, California. You waive any objection to venue in such courts and consent to personal jurisdiction in such courts.

Waiver of Class Actions

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Face Aging AI regarding the Service and supersede all prior agreements and understandings, whether written or oral, regarding the Service.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Waiver

No waiver by Face Aging AI of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice. Any attempted assignment in violation of this section shall be null and void.

Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
